I understood the code in a wrong way. Because you return the samples anyway, it would be less confusing if you would return it there instead of return SampleSystematic(splitIndex, samples, fillFrom + sampleCount - splitIndex);

Or then don't return it at all, because std::vector<E> & samples should put the to the original list ( google 'Passing vector by reference').
